(A) DoE - POLICY GUIDELINES ON ARBITRATION AND ADJUDICATORS

In context to DOE's guidelines, CMD/MRVC has approved following items.  Compliance of the same may be ensured.  

1. Incorporate arbitration clause in the contracts/tenders where the dispute value is less than Rs.10 crore. This figure is with reference to the value of the dispute and not the value of the contract. It is to be specifically mentioned in the bid conditions/ conditions of contract that in all other cases, arbitration will not be a method of dispute resolution in the contract. (Inclusion of arbitration clauses covering disputes with a value exceeding Rs.10 Crore should be done with recording of reasons and approval of CMD).

2. Contracts having dispute value more than Rs.10 Crore shall be dealt with litigation in the court of law.
